Sealed and Restricted Civil Records in Syracuse
Most civil court records in Syracuse are open to anyone who asks. Judiciary Law Section 255 gives the public a right to access court records. The courts are outside the reach of FOIL because Public Officers Law Section 86 says the judiciary is not a state "agency."
Certain records have restrictions. Matrimonial cases are sealed under Domestic Relations Law Section 235. No one but the parties or their lawyers can see the file without a court order. Family Court records are confidential under Family Court Act Section 166. If a judge seals a civil case file under 22 NYCRR Section 216.1, the order must include a written finding of good cause. The judge weighs public interest against the privacy concerns. Criminal records can also be sealed under CPL Section 160.50 when the charges are dismissed or the person is acquitted.
Adoption records are permanently sealed under Domestic Relations Law Section 114. Youthful offender records are sealed under CPL Section 720.35. These restrictions apply to all courts in Onondaga County, not just Syracuse.
